1. Who we are

This website, mindworkseu.com, is operated by Mindwork Games Srls, a company incorporated in Italy with registered office at Via Arapietra 21, 65124 Pescara (PE), Italy, VAT number IT02311650689.

Mindwork Games Srls is the data controller for the personal data described in this policy.

We have not appointed a Data Protection Officer, as we are not required to do so. For any question about this policy or about how we handle your personal data, write to customercare@mindworkgames.net.

2. What we collect

When you place an order: your name, billing and delivery address, email address, telephone number, order contents and order history. Payment card details are entered directly into the payment provider's systems and are never stored by us.

When you create an account: the details above, plus your login credentials, which are stored in encrypted form.

When you subscribe to our newsletter: your email address and, where you provide it, your name.

When you contact us: the content of your message and the address you sent it from.

When you browse the site: your IP address, device and browser type, pages viewed, referring page, and the identifiers stored by cookies and similar technologies. Section 8 explains this in detail.

3. Why we process it, and on what basis

Purpose Legal basis
Taking, fulfilling and delivering your order; handling returns and refunds Performance of a contract, Art. 6(1)(b) GDPR
Issuing invoices and keeping accounting and tax records Legal obligation, Art. 6(1)(c) GDPR
Answering your questions and providing customer support Performance of a contract, or our legitimate interest in responding to you, Art. 6(1)(f) GDPR
Sending marketing emails and newsletters Your consent, Art. 6(1)(a) GDPR, which you may withdraw at any time
Analytics, advertising and audience measurement Your consent, Art. 6(1)(a) GDPR, given through the cookie banner
Preventing fraud and securing the site Our legitimate interest in protecting the shop and our customers, Art. 6(1)(f) GDPR

Providing the data needed to complete an order is necessary to enter into the contract. Without it we cannot sell to you. Everything else is optional.

4. Who we share it with

We do not sell your personal data. We share it only with the providers who make the shop work, and only to the extent each of them needs:

  • Shopify Inc. — the platform the shop runs on, and our payment processing
  • Sendcloud and the carriers it books, currently Spring GDS — shipping and tracking
  • Omnisend — newsletters and marketing email
  • AMP Back in Stock and STOQ — back-in-stock notifications, where you ask for one
  • GOAFFPRO — our affiliate programme
  • MRPeasy — production and inventory management
  • Order Printer Pro and Digital Products — order documents and digital delivery
  • Shopify Inbox — live chat, where you use it
  • Meta Platforms Ireland Ltd. and Google Ireland Ltd. — advertising measurement and site analytics, only where you have consented
  • Our accountants, and public authorities where the law requires it

5. Sending data outside Europe

Some of these providers are based outside the European Economic Area, or use infrastructure that is. Where personal data is transferred outside the EEA or the UK, that transfer relies on an adequacy decision by the European Commission, or on Standard Contractual Clauses approved by the Commission, together with additional safeguards where they are needed.

You may ask us for a copy of the safeguards applying to any specific transfer.

6. How long we keep it

Orders, invoices and accounting records: ten years from the end of the tax year in which the transaction took place, as Italian law requires.

Everything else is kept for as long as it is needed for the purpose it was collected for, and then deleted. If you withdraw your newsletter consent, or ask us to close your account, we act on it without undue delay and keep only what the ten-year rule above obliges us to keep.

7. Your rights

Under the GDPR, and under the UK GDPR if you are in the United Kingdom, you have the right to:

  • access the personal data we hold about you, and receive a copy of it
  • rectify it, if it is inaccurate or incomplete
  • erase it, in the circumstances the law provides for
  • restrict how we process it
  • object to processing based on our legitimate interests, and to object at any time to processing for direct marketing
  • receive it in a portable format, and have it transmitted to another controller where technically feasible
  • withdraw your consent at any time, where processing is based on consent. Withdrawing consent does not affect the lawfulness of what we did before you withdrew it.

To exercise any of these, write to customercare@mindworkgames.net or use the forms on our data request pages. We will respond within one month.

You also have the right to complain to a supervisory authority. In Italy this is the Garante per la protezione dei dati personali (www.gpdp.it). If you are in another EU country you may complain to your own national authority; if you are in the United Kingdom, to the Information Commissioner's Office (www.ico.org.uk).

8. Cookies and tracking

We use cookies and similar technologies. Those strictly necessary to run the shop — keeping your basket, keeping you logged in, security — are set without consent, because the site cannot work without them.

All others, including analytics and advertising cookies set by Google and Meta, are set only after you have consented through the banner shown on your first visit. You can change or withdraw that choice at any time through the cookie settings link in the footer.

9. Children

Our products are not intended for children under 14, and this shop is not directed at them. We do not knowingly collect personal data from children under 14. If you believe a child has provided us with personal data, write to us and we will delete it.

10. Changes to this policy

If we change this policy we will update the date at the top of this page. Where the change is significant we will tell you directly, by email or through a notice on the site.
